SeparationIf you have decided to separate but are not ready to start a divorce than we can still help you with the legal implications of this, including drafting a deed of separation if there is to be an interim financial settlement. A deed of separation is effectively a contract between you and your spouse reflecting what you have agreed financially pending an eventual divorce. It is only enforceable through the courts as a breach of contract and therefore is not as powerful as a court order in the context of a divorce itself. Sometimes people prefer to obtain a deed of separation if they do not wish to get divorced for religious reasons. After two years you can get divorced with the consent of your spouse or alternatively five years without consent to avoid having to make any allegations of fault against the other party.
